    1. COMMERCIAL POLICY

    1.1 The Seller offers the products for sale on https://www.progetto-due.com and carries out its electronic commerce activity exclusively towards its end users who are 'consumers'.

    1.2 By 'consumer' we mean any natural person who acts on https://www.progetto-due.com for purposes not related to their commercial, entrepreneurial or professional activity, if any. Those who are not 'consumers' are invited to refrain from concluding commercial transactions on https://www.progetto-due.com .

    1.3 In consideration of its commercial policy, the Seller reserves the right not to process orders from parties other than the 'consumer' or in any case orders that do not comply with its commercial policy.

    1.4 These General Conditions of Sale regulate exclusively the offer, forwarding and acceptance of purchase orders for products on https://www.progetto-due.com , between users of https://www.progetto -due.com and the Seller.

    1.5 The General Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller who are present on https://www.progetto-due.com via links, banners or other hyperlinks.     1. HOW TO CONCLUDE THE CONTRACT WITH THE SELLER

    2.2 Before proceeding with the purchase of the products, by sending the order form, the Consumer will be asked to carefully read the General Conditions of Sale and the Information on the Right of Withdrawal, to print a copy using the print command and to store or reproduce a copy for personal use.     2.3 In the order form, displayed immediately before the conclusion of the purchase contract, the Seller will provide summary information about the essential characteristics of each product ordered, the price (including all applicable taxes or duties) and shipping costs (including any additional costs incurred for choosing a different and/or faster type of shipping and delivery than the standard one). The contract is concluded when the Seller receives the order form electronically, after verifying the correctness of the data relating to your order.

    2.4 The order form will be stored in the Seller's database. The Consumer will be able to access his order form by consulting the "My order" section (in the Personal Profile).

    2.5 When transmitting the order form, the Consumer will be warned that such forwarding implies the obligation to pay the indicated price. Before proceeding with the transmission of the order form, confirmation of acceptance of the Conditions of Sale will be requested.

    2.6 The language available to conclude the contract with the Seller is Italian.

    2.7 Once the contract is concluded, the Seller will take charge of the purchase order.

    2.8 The Seller may not process purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. In these cases, the Seller will inform the Consumer by email that the contract is not concluded and that the Seller has not followed up on the purchase order, specifying the reasons. If the products, presented on https://www.progetto-due.com , are no longer available or on sale at the time of the last access to the site or of sending the order form, it will be the Seller's responsibility to promptly communicate and in any case within thirty (30) days starting from the day following the day on which the order was sent to the Seller, any unavailability of the products ordered.     2.9 By electronically transmitting the order form, the Consumer unconditionally accepts and undertakes to observe, in relations with the Seller, these General Conditions of Sale. If the Consumer does not agree with some of the terms reported in the General Conditions of Sale, he is invited not to submit the order form for the purchase of the products on https://www.progetto-due.com .

    2.10 By sending the order form, the Consumer confirms that he knows and accepts the General Conditions of Sale and the further information contained in https://www.progetto-due.com , also referred to via links, including the General Conditions of Use and the Privacy Policy and the Information on the Right of Withdrawal.

    2.11 Once the Contract is concluded, the Seller will send the Consumer, by e-mail, an order confirmation communication with a summary of the items purchased, the data entered which will be used for invoicing and shipping the order, and the chosen payment method and the total amount.

    1. GUARANTEES AND INDICATION OF THE PRICES OF THE PRODUCTS

    3.1 On https://www.progetto-due.com only products marked by the PROGETTO DUE srl company brands are offered for sale.

    3.2 The Seller does not sell used, irregular or lower quality products than the corresponding standards offered on the market.

    3.3 The essential characteristics of the products are presented on https://www.progetto-due.com within each product sheet. However, the images and colors of the products offered for sale on https://www.progetto-due.com may not correspond to the real ones due to the Internet browser and monitor used.

    3.4 Product prices may be subject to updates. Check the final sales price before submitting the relevant order form.

    3.5 All products are equipped with a disposable guarantee seal. We ask you not to remove the relevant seal from the products purchased, of which it constitutes an integral part.

    3.6 The Seller, in the event of the Customer exercising the right of withdrawal, has the right not to accept the return or not to fully refund the sums paid for the purchase, in relation to those products that are not provided with the relevant tags and guarantee seals or which have been altered in their essential and qualitative characteristics or which have been damaged.

    1. PAYMENTS

    4.1 To pay the price of the products and the related shipping and delivery costs, the Customer may follow one of the methods indicated in the order form. In no case will the Customer be charged for costs exceeding those actually incurred by the Seller, in relation to the chosen payment instrument (credit card or PayPal).

    4.2 In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to BANCA DI CREDITO COOPERATIVO DI ALBEROBELLO - Martina branch Franca or other banks, which provide the relevant remote electronic payment services, without third parties being able to have access to them in any way. Furthermore, this information will never be used by the Seller except to complete the procedures relating to the purchase and to issue the relevant refunds in the event of any product returns, following the exercise of the right of withdrawal by the Customer, or if it is necessary to prevent or report to the police the commission of fraud on https://www.progetto-due.com . The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to the Customer's current account when the transaction is confirmed.

    1. SHIPPING AND DELIVERY OF PRODUCTS

    5.1 Shipments to Italy are made via Fedex/TNT courier. Ordinary shipping costs amount to fifteen (15) euros, however the Customer can take advantage of free shipping when expressly declared . As required by the laws regulating trade, all shipments are accompanied by an official invoice which declares the value of the individual items in Euros. For items on sale, the invoice shows the discounted amounts.

    5.2 Shipments abroad are made via Fedex/TNT courier. The shipping cost is automatically calculated during the purchase procedure after selecting the country of destination of the order.

    As required by the laws regulating trade, all Progetto Due shipments are accompanied by an official invoice declaring the value of the individual items in Euros. For items on sale, the invoice shows the discounted amounts.

    5.3 We ship all orders received by 11.00 am from Monday to Friday on the first following working day. If the order is placed on a public holiday or the day before a holiday, the package will be shipped on the first working day.

    Starting from shipment, delivery times require:

    • 1-3 working days in Italy (+1 day for Sicily and Sardinia)
    • 4-6 working days in the European Union
    • 8-10 working days in non-EU countries.

    In case of payments by bank transfer, the shipment is made on the working day on which the amount is accounted for in our bank account if the accounting is before 12.00 am (otherwise, the following working day).

    During the period of sales and promotions, orders are processed in chronological order of receipt, so shipments may be delayed by up to 5 working days compared to what is stated above.

    5.4 Orders are shipped on the first working day following the one on which the order was placed, subject to confirmation of the availability of the goods and verification of the bank details. Your credit card will be charged on the day of shipment. We would like to remind our customers that the order must receive a final verification from the bank: this means that our banking institution will attempt to contact your bank so that your details are confirmed and the shipment can then proceed. This verification could cause a delay of 1-2 working days in the shipment of the first order. To avoid delays in your order, you must ensure that your billing address is the same as your card account and that the cardholder's name is written as it appears on the card.

    5.5 Customers can receive information on the status of their order directly on their personal profile. Orders are delivered from 9.00 to 18.00 from Monday to Friday.

    5.6 When the order is shipped, Progetto Due sends its customers an e-mail containing the shipping number provided by the courier in charge. Customers can follow the status of their order directly on their personal profile or on the courier's website using the appropriate tracking code. The displayed web page will show the exact and updated movements of your shipment.

    5.7 Progetto Due shipments are insured against theft, loss and accidental damage. Once the shipment reaches its destination, the insurance becomes invalid. By signing on delivery, responsibility for the goods passes to the buyer. The person who signs, in fact, confirms the receipt of delivery of the package and is responsible for the package itself.

    5.8 Upon delivery of the goods, customers are asked to carefully inspect the package before signing as proof of receipt of the shipment. Progetto Due packages are carefully packaged in boxes or with resistant plastic bag packaging. If for any reason the package appears to have been tampered with or if the adhesive tape is not intact, customers are asked to sign the receipt with reservation, or refuse the delivery. In the event that the delivery has been accepted with an unauthorized signature or there is evidence of tampering with the package, customers are asked to immediately report the incident to the local Fedex/TNT office and contact Progetto Due at the email address customercare@progetto -due.com . If for any reason the shipment cannot be successfully delivered to the address provided by the customer in the commercial contract, the package risks being returned to the sender at the customer's expense. These amounts will be deducted from any refund due to the customer by Progetto Due.

    Shipments destined outside the EU are subject to import taxes based on the internal regulations of each State also for the return of the goods to the sender. The payment of these taxes is necessary to exempt the order from customs duties and are the exclusive responsibility and responsibility of the end customer. These amounts will be deducted from any refund due to the customer by Progetto Due.

    5.9 In case of non-delivery of the shipment, Fedex/TNT leaves a notice to the recipient to redefine the delivery. If the second delivery attempt also fails, the goods go into storage: they are kept at the Fedex/TNT branch closest to the delivery location. At this point an email is sent to the person who commissioned the shipment, asking for instructions on what to do. There are 4 possibilities:

    - Redelivery to the same address (with verification of recipient presence): this option has an additional cost equal to the original shipment;

    - The recipient collects the shipment at the Fedex/TNT branch within 5 working days of receiving the email: this option is free;

    - Delivery to a new address: this option has an additional cost equal to the original shipping;

    - Return of the shipment to the sender: this option has an additional cost equal to the original shipment.

    Progetto Due reserves the right to request the return of the goods after three (3) working days, in the absence of instructions from the end customer. There is a maximum storage period of 30 days at the nearest Fedex/TNT branch, storage and management costs are borne by the customer.

    5.10 As required by international trade regulations, all Progetto Due shipments are shipped from Martina Franca with an official invoice declaring the exact value in Euros of the items shipped. It is illegal to declare amounts lower than current amounts or require items to be declared as gifts. For items on sale, the relevant invoice and receipt show the discounted amounts. For customers residing outside the European Union, the total of the final invoice/receipt is calculated by subtracting the Value Added Tax and adding, if applicable, shipping costs. The Customer is asked to pay attention to what is reported in this section because the information contained therein forms an integral and substantial part of these General Conditions of Sale and, therefore, are considered fully known and accepted at the time of transmission of the order form.

    1. RIGHT OF WITHDRAWAL

    7.1 The Customer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days from the day of receipt of the products purchased on https://www.progetto-due.com . However, it is not possible to change the chosen model with another, unless the Seller, at its discretion, decides to accept the request.

    7.2 To withdraw from the contract, the Customer can use the Return Form (conforming to the standard form pursuant to art. 49, paragraph 4 of the consumer code) to be filled in and sent directly online via https://www.progetto-due .com , or draw up and send to the Seller another explicit declaration of his decision to withdraw from the contract. If the Customer chooses to use the Return Form to be sent directly online, the Seller will send confirmation by e-mail of receipt of the withdrawal request. If the Customer chooses, however, to send another declaration of withdrawal, he has the burden of proving the correct and timely exercise of the right of withdrawal.

    7.3 Once the withdrawal from the contract has been exercised, the Customer must return the products to the Seller by handing them over to the courier for shipment within fourteen (14) days starting from when he communicated the decision to withdraw from the contract to the Seller.

    7.4 The only costs borne by the Customer are those of returning the purchased products, unless the Seller has expressly exempted them from such costs at the time of purchase and on the further condition that the Customer uses the courier indicated by the Seller. This option is valid only for Italian returns.

    7.5 If the Customer decides to use the courier indicated by the Seller, he/she will not have to personally pay the costs for returning the purchased products. Payment of the costs of returning the purchased products will be made, on your behalf, directly by the Seller, who will therefore free you from any payment obligation towards the shipper. For the payment of the refund, if applicable, the Seller will withhold the cost of fifteen (15) Euros from the refund. Furthermore, from the moment of delivery of the purchased products to the courier indicated by the Seller, the Seller exempts the Customer from any responsibility in the event of loss or damage to the products during transport. This option is valid only for Italian returns.

    7.6 If the Customer decides to use a shipping method other than that indicated by the Seller, he/she will instead have to personally pay the costs, at his/her own expense, for returning the purchased products. In this case, any additional costs incurred for choosing a different and/or faster type of shipping and delivery than the standard one will not be refunded. In this case, you remain responsible in the event of loss or damage to the products during transport, which is due to your negligent choice of carrier and/or shipping methods.

    7.7 For returns relating to non-EU orders, the shipping costs for returning the garments and any other related amounts such as local taxes, customs duties, import duties and/or customs clearance of goods are the responsibility of the Customer and will be deducted from the final refund. The returned goods must be sent to Progetto Due srl - Via Mottola km 2,200 industrial area - 74015 Martina Franca (TA) - ITALY . The Customer is asked to insure the shipment. The Seller is not responsible for any loss, damage or delay in delivery of the return.

    7.8 The Right of Withdrawal - in addition to compliance with the terms and methods described in the previous points 7.1, 7.2, 7.3 and 7.4 - is considered exercised correctly if the following conditions are also fully respected:

      1. The Return Form transmitted directly online or another explicit statement of the decision to withdraw from the contract must be correctly filled out and transmitted to the seller within fourteen (14) days of receiving the products;
      2. The products must not have been used, worn, or washed;
      3. The identification tags must still be attached to the products with the disposable warranty seal that is an integral part of the goods;
      4. The returned products must be in their original packaging;
      5. The returned products must be handed over to the courier within fourteen (14) days from when the customer communicated the decision to withdraw from the contract to the seller;
      6. The products must not be damaged.

      7.9 If the Right of Withdrawal is exercised following the methods and terms indicated in this paragraph 7, the Seller will reimburse any sums already collected for the purchase of the products according to the methods and terms established.

      7.10 The sums will be refunded to the Customer as quickly as possible and, in any case, within fourteen (14) working days from the moment the return is returned to the Seller's warehouses located in Via Mottola km 2,200 industrial area, 74015 Martina Franca ( TA) - ITALY .

      7.11 If the methods and terms for exercising the right of withdrawal, referred to in letters a), e) and f) of the previous paragraph 7, are not respected, the Customer will not be entitled to a refund of the sums already paid to the Seller. Within 14 days of sending the e-mail notifying the non-acceptance of the return, the Customer may choose to regain, at his own expense, the products in the state in which they were returned to the Seller, by communicating this to the Seller himself, according to the methods that will be communicated. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase. If the conditions referred to in letters b), c) and d) of the previous paragraph 7.7 are not respected, the Customer will not be entitled to a full refund of the sums already paid to the Seller. In fact, it will be responsible for the decrease in value of the returned products resulting from use other than that authorized by the Seller for the purpose of ascertaining the nature, characteristics and functioning of the products themselves. In this case, a percentage between 10 and 90 percent of the sums paid to the Seller for the purchase of the returned products will be deducted from the expected refund, as specifically communicated by the Seller via email. Within 14 days of sending the e-mail in which the amount deducted from the refund will be communicated, the Customer may choose to regain, at his own expense, the products in the state in which they were returned to the Seller, by communicating this to the Seller himself, according to the methods that will be communicated. Otherwise, the Seller may retain the products and an amount corresponding to the percentage deducted from the refund.

      1. REFUND TIMES AND METHODS

      8.1 After returning the products, the Seller carries out the necessary checks relating to their conformity with the conditions and terms indicated in paragraph 7. In the event that the checks are concluded positively, the Seller will send the Customer, via e-mail, the relevant confirmation of acceptance of the products thus returned. In the event that the checks are not concluded positively, the Seller will communicate to the Customer, via e-mail, the found existence of a decrease in value of the returned products, resulting from failure on his part to comply with the conditions indicated in the previous paragraph. 7.3. At the same time, the Seller will also communicate the amount that will be deducted from the sums paid for the purchase of the returned products; without prejudice, alternatively, to the possibility of regaining, at your expense, the products in the state in which they were returned to the Seller, in accordance with the provisions of the previous paragraph 7.10.

      8.2 Regardless of the payment method used by the Customer, the refund, in whole or in part, is activated by the Seller, in the shortest possible time within fourteen (14) working days from receipt of the returned goods at the warehouses, using the same method used for the payment of the order, after verifying the correct execution of the right of withdrawal and verification of the returned products.

      8.3 The Seller carries out the refund using the same payment method used for the purchase of the returned products. Refunds for orders paid on delivery are made via bank transfer or PAYPAL credit. If there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the sums due for their purchase, the reimbursement of the sums, in the event of exercise of the right of withdrawal, will be carried out by the Seller, in in any case, towards the person who made the payment.

      8.4 In case of refund by credit card, the value date of the credit is the same as the debit.

      8.5 The Seller indicates the Fedex/TNT courier as the shipping company for returning the products. By following the instructions that the Seller sends to the Customer via e-mail following the return request/communication for freight collect, the Customer will be able to return the products to the Seller, without personally paying the necessary costs. According to the methods and terms established for the exercise of the right of withdrawal, this method allows the Seller to pay directly, on his behalf, the costs of returning the purchased products, freeing the Customer from any payment obligation towards the shipper. This method also allows you to check, at any time, where each package is, freeing the Customer from any responsibility in the event of loss or damage to the products during transport. This option is valid only for Italy.

      8.6 If the Customer decides to use a courier other than the one indicated by the Seller to return the products, he or she will have to pay the necessary expenses himself and will be responsible for any liability in the event of loss or damage to the products. during transport, according to the methods and terms established for the exercise of the right of withdrawal. This option is mandatory for countries outside Italy. For details, please refer to points 7.6 and 7.7 of these Conditions of Sale.

      1. APPLICABLE LAW AND DISPUTE RESOLUTION

      10.1 The General Conditions of Sale are governed by Italian law and in particular by legislative decree 6 September 2005 n. 206, on the consumer code in Chapter I "Consumer rights in contracts", with specific reference to the legislation on distance contracts and the legislative decree of 9 April 2003 n. 70 on certain aspects concerning electronic commerce.

      10.2 In the event of disputes between the Seller and each end user, arising from the General Conditions of Sale, reference is made to the Court of Taranto.

      10.3 As per the European regulation on Online Dispute Resolution (ODR) - regulation (EU) No. 524/2013 of the European parliament of 21 May 2013 - To resolve disputes with companies out of court arising from purchases of goods and services made online or through online markets (so-called Marketplaces), consumers can connect to the ODR telematic platform, managed by the European Commission, reachable at https://webgate.ec.europa.eu/odr ; once connected, the Customer can choose the body to contact to resolve the dispute and activate the relevant procedure.
