The offer and sale of products on our website (https://www.progetto-due.com) are governed by these General Terms and Conditions of Sale. - BUSINESS POLICY
1.1 The Seller offers products for sale on https://www.progetto-due.com and carries out its e-commerce business exclusively towards its end users who are 'consumers'.
1.2 'Consumer' means any natural person who is acting on https://www.progetto-due.com for purposes which are outside his or her trade, business or professional activity. Any subject who is not a 'consumer' is invited to refrain from concluding commercial transactions on https://www.progetto-due.com.
1.3 In view of its business policy, the Seller reserves the right not to process orders received from users who are not 'consumers' and any other order which does not comply with its business policy.
1.4 These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on https://www.progetto-due.com between the users of https://www.progetto-due.com and the Seller.
1.5 The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties that are present on https://www.progetto-due.com through links, banners or other hypertext links. Before sending orders and purchasing products and services from third parties, we recommend that you verify their terms and conditions, since the Seller shall under no circumstances be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between users of https://www.progetto-due.com.
- HOW TO CONCLUDE A CONTRACT WITH THE SELLER
2.1 To conclude the purchase contract for one or more products on https://www.progetto-due.com, the Consumer must fill out the order form in electronic format and transmit it to the Seller electronically, following the relevant instructions.
2.2 Before proceeding with the purchase of the products by transmitting the order form, the Consumer will be asked to carefully read the General Terms and Conditions of Sale and the Information on the Right of Withdrawal, to print a copy using the print command, and to save or reproduce a copy for their own personal use. The Seller will also provide a summary of the commercial and contractual conditions proposed for the purchase of the products, which contains a reference to the General Terms and Conditions of Sale and a summary of the information on the essential characteristics of each product ordered with its relative price (including all applicable taxes or duties), the means of payment that can be used to purchase each product, the delivery methods for the purchased products, shipping and delivery costs; as well as the Seller's references, geographical address, and e-mail address. The Seller will also provide a summary of the terms and conditions for exercising the right of withdrawal and the modalities and times for the return of the purchased products. An indication of the circumstances in which the Consumer loses the right to withdraw from the contract will also be provided. If applicable to the purchase, the Consumer will be informed that, in the event of withdrawal, they will have to bear the cost of returning the products. In any case, the Consumer will be reminded of the existence of the legal guarantee of conformity for the products, and the contact details of the after-sales assistance service will be provided.
2.3 In the order form, displayed immediately before the conclusion of the purchase contract, the Seller will provide summary information regarding the essential characteristics of each ordered product, the price (inclusive of all applicable taxes or duties), and the shipping costs (including any supplementary costs incurred for having chosen a type of shipping and delivery different from and/or faster than the standard one). The contract is concluded when the Seller receives the order form electronically, subject to verification of the correctness of the data relating to your order.
2.4 The order form will be filed in the Seller's database. The Consumer will be able to access their order form by consulting the "My Order" section (in their Personal Profile).
2.5 When proceeding to transmit the order form, the Consumer will be warned that such submission implies the obligation to pay the indicated price. Before proceeding to transmit the order form, confirmation of acceptance of the Terms and Conditions of Sale will be requested.
2.6 The language available for concluding the contract with the Seller is Italian.
2.7 Once the contract is concluded, the Seller will take charge of the purchase order.
2.8 The Seller may refuse to process purchase orders that do not give sufficient guarantees of solvency, or that are incomplete or incorrect, or in the event that products are unavailable. In these cases, the Seller shall inform the Consumer by e-mail that the contract has not been concluded and that the Seller has not processed the purchase order, specifying the reasons. If the products presented on https://www.progetto-due.com are no longer available or on sale at the time of the last access to the website or upon sending the order form, it shall be the Seller’s responsibility to communicate, promptly and in any case within thirty (30) days from the day following the transmission of the order to the Seller, the potential unavailability of the ordered products. In the event the order form has been submitted and the price paid, the Seller shall refund, without undue delay, the amount already paid in advance, and the contract shall be considered terminated between the parties.
2.9 By submitting the order form electronically, the Consumer unconditionally accepts and undertakes to observe these General Terms and Conditions of Sale in their dealings with the Seller. Should the Consumer not agree with certain terms contained in the General Terms and Conditions of Sale, they are invited not to submit the order form for the purchase of products on https://www.progetto-due.com.
2.10 By transmitting the order form, the Consumer confirms that they know and accept the General Terms and Conditions of Sale and the further information contained in https://www.progetto-due.com, also referred to via links, including the General Terms and Conditions of Use, the Privacy Policy, and the Information on the Right of Withdrawal.
2.11 Once the Contract is concluded, the Seller will transmit to the Consumer, by e-mail, an order confirmation receipt containing a summary of the purchased items, the entered data that will be used for billing and shipping the order, the chosen payment method, and the total amount.
- GUARANTEES AND INDICATION OF PRODUCT PRICES
3.1 On https://www.progetto-due.com, only products marked with the corporate trademarks of PROGETTO DUE srl are offered for sale.
3.2 The Seller does not sell used, irregular products or products of a quality lower than the corresponding market standards.
3.3 The essential characteristics of the products are presented on https://www.progetto-due.com inside each product sheet. However, the images and colors of the products offered for sale on https://www.progetto-due.com may not correspond to the real ones due to the Internet browser and monitor used.
3.4 Product prices may be subject to updates. Please check the final selling price before submitting the relevant order form.
3.5 All products are fitted with a single-use guarantee seal. We ask you not to remove this seal from the purchased products, of which it forms an integral part.
3.6 In the event the Customer exercises their right of withdrawal, the Seller has the right not to accept the return or not to fully refund the sums paid for the purchase, in relation to those products that lack their respective tags and guarantee seals, or that have been altered in their essential and qualitative characteristics, or that have been damaged.
3.7 All products sold on https://www.progetto-due.com are covered by a 24-month Legal Guarantee for lack of conformity, pursuant to applicable laws (Legislative Decree 206/2005). In the event of receiving defective or non-compliant products, the Customer has the right to the restoration of product conformity free of charge by repair or replacement, or to an appropriate reduction in the price, or to the termination of the contract. To exercise this right, the Customer must contact Customer Service.
- PAYMENTS
4.1 To pay the price of the products and the relevant shipping and delivery costs, the Customer may follow one of the methods indicated in the order form. Under no circumstances will the Customer be charged costs higher than those actually incurred by the Seller, in relation to the chosen payment instrument (credit card or PayPal).
4.2 In case of payment by credit card, financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to BANCA DI CREDITO COOPERATIVO DI ALBEROBELLO - Martina Franca Branch or to other banks, which provide the relative remote electronic payment services, without third parties having access thereto in any way. Furthermore, such information will never be used by the Seller except to complete the procedures relating to the purchase and to issue the relative refunds in case of any return of the products, following the exercise of the right of withdrawal by the Customer, or whenever it becomes necessary to prevent or report to the police forces the commission of frauds on https://www.progetto-due.com. The price for the purchase of the products and the shipping costs, as indicated in the order form, will be debited to the Customer's bank account at the moment the transaction is confirmed.
- SHIPPING AND DELIVERY OF PRODUCTS
5.1 Shipments in Italy are made via FedEx/TNT courier. Standard shipments in Italy are always free. Shipments abroad amount to fifteen (15) euros, however the Customer may take advantage of free shipping when expressly stated. As required by trade laws, all shipments are accompanied by an official invoice declaring the value of the individual items in Euros. For sale items, the invoice indicates the discounted amounts.
5.2 Shipments abroad are made via FedEx/TNT courier. The shipping cost is automatically calculated during the purchase procedure after selecting the destination Country of the order.
As required by the laws regulating commerce, all Progetto Due shipments are accompanied by an official invoice declaring the value of the individual items in Euros. For sale items, the invoice indicates the discounted amounts.
5.3 We ship on the next business day all orders received by 11:00 a.m. from Monday to Friday. If the order is placed on a public holiday or the day before a public holiday, the package will be shipped on the first available business day.
Starting from dispatch, delivery times take:
- 1-3 business days in Italy (+1 day for Sicily and Sardinia)
- 4-6 business days in the European Union
- 8-10 business days in non-EU countries.
In case of payments by bank transfer, shipping is carried out on the business day on which the amount is credited to our bank account if the crediting occurs before 12:00 a.m. (otherwise, on the following business day).
During sales and promotional periods, orders are processed in chronological order of receipt, so shipments may suffer up to 5 business days of delay compared to what is stated above.
5.4 Orders are shipped on the first working day following the day the order was placed, subject to confirmation of the availability of the merchandise and verification of bank details. The credit card will be charged on the day of shipment. We wish to remind our customers that the order must undergo a final verification by the bank: this means that our banking institution will attempt to contact your bank so that your details are confirmed and shipping can therefore proceed. This verification could cause a delay of 1-2 business days in the shipping of your first order. To avoid delays in your order, please ensure that the billing address matches the card's bank account and that the cardholder's name is written exactly as it appears on the card itself.
5.5 Customers can receive information on the status of their order directly on their personal profile. Orders are delivered from 9:00 a.m. to 6:00 p.m., Monday to Friday.
5.6 At the time of order shipment, Progetto Due sends its customers an e-mail containing the tracking number provided by the appointed courier. Customers can track the status of their order directly on their personal profile or on the website of the courier used via the dedicated tracking code. The displayed webpage will show the exact and updated movements of your shipment.
5.7 Progetto Due shipments are insured against theft, loss, and accidental damage. Once the shipment reaches its destination, the insurance loses its validity. With the signature upon delivery, the responsibility for the merchandise passes to the buyer. The person who signs, in fact, confirms the receipt of delivery of the package and is responsible for the package itself.
5.8 Upon delivery of the merchandise, customers are kindly requested to carefully inspect the package before affixing a signature as proof of receipt of the shipment. Progetto Due packages are carefully wrapped in boxes or in durable plastic envelope packaging. If for any reason the packaging appears tampered with or if the adhesive tape is not intact, customers are asked to sign the receipt subject to reservation, or to refuse the delivery. In the event that the delivery has been accepted with an unauthorized signature or there is evidence of tampering with the package, customers are asked to immediately report the incident to the local FedEx/TNT office and to contact Progetto Due at the e-mail address customercare@progetto-due.com. If for any reason the shipment cannot be successfully delivered to the address provided by the customer in the commercial contract, the package risks being returned to the sender at the customer's own expense. Such amounts will be deducted from any refund due to the customer by Progetto Due.
Shipments destined outside the EU are subject to import taxes based on the domestic regulations of each State, also for the return of the merchandise to the sender. The payment of these taxes is necessary to release the order from customs duties and are the sole competence and responsibility of the final customer. Such amounts will be deducted from any refund due to the customer by Progetto Due.
5.9 In the event of failed delivery of the shipment, FedEx/TNT leaves a notice for the recipient to reschedule the delivery. If the second delivery attempt is also unsuccessful, the merchandise goes into storage: it is held at the FedEx/TNT branch closest to the delivery location. At this point, an e-mail is sent to the party who commissioned the shipment, asking for instructions on how to proceed. There are 4 options:
- Redelivery to the same address (with verification of the recipient's presence): this option has an additional cost equal to the original shipping fee;
- The recipient picks up the shipment at the FedEx/TNT branch within 5 business days of receiving the e-mail: this option is free;
- Delivery to a new address: this option has an additional cost equal to the original shipping fee;
- Return of the shipment to the sender: this option has an additional cost equal to the original shipping fee.
Progetto Due reserves the right to request the return of the merchandise after three (3) business days have elapsed without instructions from the final customer. A maximum storage period of 30 days is provided at the nearest FedEx/TNT Branch; storage and handling fees shall be borne by the customer.
5.10 As required by international trade regulations, all Progetto Due shipments are dispatched from Martina Franca with an official invoice declaring the exact value in Euros of the shipped items. It is illegal to declare amounts lower than actual ones or to request that items be declared as gifts. For sale items, the relative invoice and receipt indicate the discounted amounts. For customers residing outside the European Union, the total of the final invoice/receipt is calculated by subtracting the Value Added Tax and adding, where applicable, the shipping costs. The Customer is requested to pay close attention to the provisions of this section because the indications contained herein form an integral and substantial part of these General Terms and Conditions of Sale and, therefore, are deemed to be fully known and accepted at the time of transmission of the order form.

- RIGHT OF WITHDRAWAL
7.1 The Customer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days starting from the day of receipt of the products purchased on https://www.progetto-due.com. However, it is not possible to exchange the chosen model for another one, unless the Seller, at its sole discretion, decides to accept the request.
7.2 To withdraw from the contract, the Customer may use the Return Form (compliant with the standard form pursuant to Art. 49, paragraph 4 of the Consumer Code) to be filled out and transmitted directly online through https://www.progetto-due.com, or draft and send to the Seller any other explicit statement of their decision to withdraw from the contract. If the Customer chooses to use the Return Form to be transmitted directly online, the Seller will send an e-mail confirming receipt of the withdrawal request. If the Customer chooses instead to send another withdrawal statement, the burden of proving the correct and timely exercise of the right of withdrawal shall rest with the Customer.
7.3 Once the withdrawal from the contract has been exercised, the Customer must return the products to the Seller by handing them over to the courier for shipping within fourteen (14) days starting from when they communicated to the Seller their decision to withdraw from the contract.
7.4 The only expenses borne by the Customer are those for returning the purchased products, unless the Seller has expressly exempted them from such expenses at the time of purchase and upon the further condition that the Customer uses the shipping agent indicated by the Seller. This option is valid only for returns within Italy.
7.5 If the Customer decides to use the shipping agent indicated by the Seller, they will not, however, have to personally pay the return shipping costs for the purchased products. The return procedure for Italy is completely free of charge and no amount will be deducted from the final refund. Payment of the return shipping costs for the purchased products will be made on their behalf directly by the Seller, who will therefore release the Customer from any payment obligation towards the shipping agent. Furthermore, from the moment the purchased products are handed back to the shipping agent indicated by the Seller, the Seller releases the Customer from any liability in the event of loss or damage to the products during transport. This option is valid only for returns within Italy.
7.6 Should the Customer decide to use a shipping method different from the one indicated by the Seller, they shall instead personally pay the return shipping costs for the purchased products. In such case, any supplementary costs incurred for having chosen a type of shipping and delivery different from and/or faster than the standard one will not be refunded. In this scenario, the Customer shall remain liable for any loss or damage to the products during transport due to their negligent choice of carrier and/or shipping method.
7.7 For returns relating to non-EU orders, the shipping costs for returning the garments and any other related amount such as local taxes, customs duties, import duties, and/or customs clearance fees shall be borne by the Customer and will be deducted from the final refund. The returned merchandise must be shipped to Progetto Due s.r.l. - Via Mottola km 2,200 zona industriale - 74015 Martina Franca (TA) - ITALY. The Customer is requested to insure the shipment. The Seller is not responsible for any loss, damage, or delay in the delivery of the return.
7.8 The Right of Withdrawal - in addition to compliance with the terms and methods described in the preceding points 7.1, 7.2, 7.3, and 7.4 - shall be deemed correctly exercised if the following conditions are also fully met:
- The Return Form transmitted directly online or any other explicit statement of the decision to withdraw from the contract must be correctly filled out and transmitted to the Seller within fourteen (14) days of receipt of the products;
- The products must not have been used, worn, or washed;
- The identification tags must still be attached to the products with the single-use guarantee seal, which forms an integral part of the goods;
- The products must be returned in their original packaging;
- The returned products must be handed over to the shipping agent within fourteen (14) days starting from when the Customer communicated to the Seller their decision to withdraw from the contract;
- The products must not be damaged.
7.9 If the Right of Withdrawal is exercised in accordance with the methods and terms indicated in this paragraph 7, the Seller shall refund any sums already collected for the purchase of the products according to the provided methods and terms.
7.10 The sums will be refunded to the Customer as soon as possible and, in any case, within fourteen (14) days from the day on which the Seller is informed of the Customer's decision to withdraw from the contract. The Seller may withhold the refund until it has received the goods or until the Customer has supplied evidence of having sent back the goods, whichever situation occurs first.
7.11 Should the methods and terms for exercising the right of withdrawal set out in letters a), e), and f) of paragraph 7 above not be respected, the Customer shall not be entitled to a refund of the sums already paid to the Seller. Within 14 days of the sending of the e-mail communicating the non-acceptance of the return, the Customer may choose to re-obtain, at their own expense, the products in the condition in which they were returned to the Seller, by giving notice to the Seller itself, according to the modalities that will be communicated. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase. Should the conditions set out in letters b), c), and d) of paragraph 7.7 above not be respected, the Customer shall not be entitled to a full refund of the sums already paid to the Seller. The Customer shall, in fact, be held liable for the decrease in value of the returned products resulting from a handling other than that authorized by the Seller for the purpose of establishing the nature, characteristics, and functioning of the products. In this event, a percentage ranging between 10 and 90 percent of the sums paid to the Seller for the purchase of the returned products will be deducted from the scheduled refund, as specifically communicated by the Seller via e-mail. Within 14 days of the sending of the e-mail communicating the amount deducted from the refund, the Customer may choose to re-obtain, at their own expense, the products in the condition in which they were returned to the Seller, by giving notice to the Seller itself, according to the modalities that will be communicated. Otherwise, the Seller may retain the products and an amount corresponding to the percentage deducted from the refund.
- TIMES AND METHODS OF REFUND
8.1 After the products have been returned, the Seller shall carry out the necessary checks regarding their conformity to the terms and conditions indicated in paragraph 7. In the event that the checks are successfully concluded, the Seller shall send the Customer, via e-mail, the relative confirmation of acceptance of the returned products. In the event that the checks are not successfully concluded, the Seller shall notify the Customer, via e-mail, of the ascertained existence of a decrease in value of the returned products, resulting from the Customer's failure to comply with the conditions set out in paragraph 7.3 above. Simultaneously, the Seller shall also communicate the amount that will be deducted from the sums paid for the purchase of the returned products; without prejudice, as an alternative, to the possibility of re-obtaining, at the Customer's own expense, the products in the condition in which they were returned to the Seller, pursuant to paragraph 7.10 above.
8.2 Whatever payment method was used by the Customer, the full or partial refund is initiated by the Seller as soon as possible and within fourteen (14) days from the day on which it is informed of the Customer's decision to withdraw from the contract, using the same payment method used for the order. The Seller may withhold the refund until it has received the goods or until the Customer has supplied evidence of having sent back the goods, whichever situation occurs first.
8.3 The Seller executes the refund using the same means of payment used to purchase the returned products. Refunds for orders paid cash on delivery are issued via bank transfer or PAYPAL credit. If there is no match between the recipient of the products indicated in the order form and the person who paid the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, shall be executed by the Seller, in any case, to the person who made the payment.
8.4 In the case of a refund via credit card, the value date of the re-credit shall be the same as the debit.
8.5 The Seller designates FedEx/TNT courier as the shipping agent for returning products. By following the instructions that the Seller sends to the Customer via e-mail following the return request/communication for carriage forward shipping, the Customer may return the products to the Seller without personally paying the necessary expenses. According to the terms and methods provided for exercising the right of withdrawal, this method allows the Seller to directly pay, on the Customer's behalf, the return shipping costs for the purchased products, releasing the Customer from any payment obligation towards the shipping agent. This method also allows tracking the location of each package at any time, releasing the Customer from any liability in the event of loss or damage to the products during transport. This option is valid only for Italy.
8.6 Should the Customer decide to use, for the return of the products, a shipping agent different from the one indicated by the Seller, they must instead personally pay the necessary expenses and shall bear any liability in the event of loss or damage to the products during transport, according to the terms and methods provided for exercising the right of withdrawal. This option is mandatory for Countries outside Italy. For details, please refer to points 7.6 and 7.7 of these Terms and Conditions of Sale.

9.1 The Customer may obtain information on how their personal data is processed by accessing the privacy policy.

- GOVERNING LAW AND DISPUTE RESOLUTION
10.1 These General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of September 6, 2005, on the Consumer Code, Chapter I "Consumer rights in contracts", with specific reference to regulations on distance contracts, and by Legislative Decree No. 70 of April 9, 2003, on certain aspects concerning electronic commerce.
10.2 In the event of disputes between the Seller and each end user arising from the General Terms and Conditions of Sale, exclusive jurisdiction shall lie with the Court of the municipality of residence or domicile of the Consumer, if located within the Italian territory.
10.3 Pursuant to the European Regulation on Online Dispute Resolution (ODR) - Regulation (EU) No. 524/2013 of the European Parliament of May 21, 2013 - To resolve out-of-court disputes with businesses arising from purchases of goods and services made online or through online marketplaces, consumers can connect to the ODR electronic platform, managed by the European Commission, accessible at https://ec.europa.eu/consumers/odr/; once connected, the Customer can choose the body to contact to resolve the dispute and initiate the relevant procedure.
- AMENDMENTS AND UPDATES
The General Terms and Conditions of Sale are amended from time to time, also taking into consideration potential regulatory changes. The new General Terms and Conditions of Sale shall be effective from the date of publication on https://www.progetto-due.com.
